jurmaana lagaya hai. Jinn 5 tyre companies’ par jurmana lagaya hai unka naam
hai - Apollo Tyres Ltd, MRF Ltd, CEAT Ltd, JK Tyre & Industries Ltd aur
Birla Tyres Ltd. Iss jurmaane ka main reason hai Cartelization
Ab aap soch rahein honge, ki kya hai yeh cartelization jiske wajah se CCI ne ek nahi balki paanch tyre companies ko ek saath fine maara – aur wo bhi crores mai – aayie chaliye dekhte hain kya hai cartelization aur kya hai ye tyre manufacturers ka majra.

Case ko samajh ne ke liye
thoda sa past mai chalte hain
Yeh penalty ka Silsila aaj ka
nahi hai balki August 2018 ka hai
jab CCI ne –
MRF
pe Rs 622.09 crore ka,
Apollo tyres pe Rs
425.53 crore ka,
JK
Tyres pe Rs 309.95 crore ka,
CEAT
pe Rs 252.16 crore ka aur
Birla
Tyres pe 178.33 crore ka jurmana lagaya tha.
Iske
alawa iss regulatory body ne Automotive Tyre Manufacturers Association (ATMA)
pe bhi 8.4 lakh ka penalty lagaya tha.
CCI
ke hisaab se inn paancho tyre companies ne saal 2011-12 mai ek kanoon toda tha
– jisse hum ‘Competition Act, 2002’ ke naam se jaante hain. CCI ka kehna tha inn
companies ne ‘Competition Act, 2002 ke section 3’ jo anti-competitive agreement
ko rokta hai, usee violate kia tha.
Companies
ne iss case ke against Madras Court mai bhi appeal ki thi jo abhi haali mai
January 6 ko dismiss hui. Dismissal ke baad bhi companies ne haar nahi maani
aur Supreme Court mai bhi appeal kiya, lekin January 28 ko ye appeal waahan bhi
radd ho gayi.
Aap ko bata dun, ye case CCI ne ek reference ke
basis pe initiate kia tha. Ye reference unhe Ministry of Corporate Affairs se
aaya tha – Ministry ko ye reference All India Tyre Dealers Federation (AITDF)
se aaya tha – inka kehna tha ki paancho company aur association ek saath milkar
market mai production aur supply ko lekar control kar rahe hain.
Sabhi cheezon ko dekh kar CCI ne paancho tyres
companies pe cartelization ka iljaam lagaya.
Toh kya Hai Ye Cartelization?
Cartelization ek illegal practise hai Jahan ‘ek’ industry ke rival
companies aapas mai milte hain, meeting karte hain, ek dusre ke saath
co-operate aur co-ordinate karte hain, sensitive-data bhi share karte hain aur
fir collectively competition ko kam karke, prices ko decide karte hain aur profit
increase karne ki yojana banate hai.
Sirf tyre companies pe hi nahi, cartelization ka accusations past
mai kayi saari Indian companies pe laga hai – jaise ki –
Car making companies – Honda, Fiat, Volkswagen, Tata Motors,
Maruti Suzuki,
E-commerce organizations – Amazon and Flipkart
iske alawa Google India ko bhi CCI ne anti-competitive, unfair aur
restrictive trade practices ke liye pichle saal katghare mai liya tha.
In addition, saal 2018 mai CCI ne kariban 10 cement companies aur
unke trade association Cement Manufacturing Association par bhi karodo ka
penalty lagaya tha.
Ab Jab Penalty Lag Gaya Hai, Question Yeh Hai ki - Kya CCI ka
Penalty Tyre Stocks Ko Effect Karega?
Well, penalty ka news aane ke baujud shares mai
zyada major ups and downs nahi dikhai diye. Kariban 10 baje jahan Apollo Tyres
aur MRF dono flat rate pe trade kar rahe the waahin baaki ke teeno share zyada
nahi balki 1 se 2% se down the. Dekha jaye toh abhi bhi ye tyre shares zyada
pressure mai nahi hain, lekin aage chalkar aa sakte hain.
Shocking baat yeh hai ki, ye koi pehli baar nahi hai
jahan tyre companies ko CCI ne price-fixing aur anti-competitive practices ke
liye penalty maara hai. Saal 2016 mai bhi CCI ne tyre manufacturers pe
cartelisation ke liye penalties impose kia tha.
Aap dekh rahein hain ki kaise sabhi industry ke
market leaders apni milli-bhagat se hum sabhi consumers ko kaise bewakoof
banate hain. Kaise tyre ho, car ho, cement ho, ya fir paper manufacturing
companies, kaise yeh koi na koi tarike se humein manipulate karne ke taalash mai rehte hain. Yahan
tak ki beer companies bhi iss unfair game mai shaamil hai aur CCI se inhe bhi
penalty padi hai.
Har business profit kamana chahta hai aur yeh koi buri baat nahi
lekin jab market mai competitors ek saath milkar price-fix karte hain toh uska
seedha asar buyers pe padta hai aur humein majburan uss daam par kharidhna hi
padta hai. Just imagine market mai koi basic item ka price shoot ho gaya aur
brand A ho ya B, C sabhi ka rate same ho aur kaafi high – toh kaise aam aadmi kharidega apna saaman? Aur jab sab mille hue
hain toh kaise aayenge naye innovative products aur manufacturers iss segment
mai? Hai na Gambhir samasya? Lekin, achi baat yeh hai ki inn sabko rokne ke
liye ek regulator body hai Competition Commission of India (CCI) aur umeed
hai ki ye apna kaam karegi aur iss mal-practice se naa hi consumers ko balki businesses ko b hi
protect karegi.
